Texas Adoption Laws

In Texas, there are specific circumstances under which you may adopt a child.

These include:

  • Termination of the parent-child relationship with both parents. You might pursue this alongside a suit for adoption.
  • Stepparent adoption (if they are married to the petitioning spouse)
  • For children at least two years old, if the parent-child relationship gets terminated with one parent, and the person seeking adoption has been a managing conservator or had actual care, possession, and control of the child for six months before the adoption. Alternatively, if the person seeking adoption is the child’s former stepparent and the non-terminated parent consents to the adoption.
  • For children at least two years old, if the parent-child relationship gets terminated with one parent, and the person seeking adoption is the child’s former stepparent, having had a managing conservatorship or actual care, possession, and control of the child for one year preceding the adoption.

Additionally, the Texas Family Code mandates an adoption evaluation, including a home study, when a person seeks to adopt a child. Consent to adoption is necessary from children aged 12 or older.

Termination of parental rights can happen without consent under certain grounds outlined in the Texas Family Code. The Department of Family and Protective Services (DFPS) may also file a suit for termination under specific circumstances, such as when a parent is unable to meet the child’s needs due to mental or emotional challenges.

Cases involving children from other states or countries must comply with the Interstate Compact on the Placement of Children (ICPC).
