Small Estate Law: Knowing your Options

In many instances a person dies with little to no property and without a will. This still requires some probate process to allow the beneficiaries and loved ones to dispose of bank accounts, real estate, motor vehicles and retirement account benefits. In these instances it is often possible to use a ‘small estate affidavit.’ The advantage of this is it can often be a cheaper and faster way to get a disposition of the estate. The disadvantage is that it requires an agreement of all potential beneficiaries.
